How Foreclosure Works in California

California forecloses nonjudicially — through the county recorder, not the courts. That makes the paper trail public and precise: a Notice of Default is recorded after roughly 90 days of missed payments and starts a three-month reinstatement window. If the loan isn't brought current, a Notice of Trustee Sale sets a public auction date at least 21 days out. At auction the property sells to the highest bidder or reverts to the lender as REO.
